Terms of Use

Welcome to Xchange Social. These Terms of Use (“Terms”) are a binding agreement between you and Khaos Adventures LLC (“Company,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Who Can Use the Service

  • You must be 18 years of age or older.
  • You are responsible for complying with all laws where you live.
  • By using the Service, you confirm you meet these requirements.

2. Your Account

  • Provide accurate and up-to-date registration information.
  • You are responsible for safeguarding your password and all activity under your account.
  • Notify us immediately of any unauthorized use.

3. What’s Allowed and Not Allowed

You may use Xchange Social to share your links and a profile photo. You may not:

  • Post or link to illegal, harmful, abusive, or exploitative content.
  • Upload files other than a profile photo.
  • Violate copyrights, trademarks, or privacy rights.
  • Harass, stalk, or exploit other users.
  • Use bots, scrapers, or automation to interfere with the platform.
  • Bypass or tamper with security measures.

4. Content You Post

  • You retain ownership of your content (links and profile photo).
  • You grant us a limited license to host and display it to provide the Service.
  • You promise you have the rights to everything you post.
  • You are responsible for your content and any outcomes of posting it.

5. Community Standards

Xchange Social is built for adults, including members of kink and alternative communities. To keep it safe and inclusive:

  • All content must be consensual.
  • No child exploitation, sexual violence, or bestiality.
  • No hate speech, discrimination, or harassment.
  • Kink and fetish expression is welcome when lawful and consensual.
  • We may remove any content or account that creates legal, safety, or reputational risk.

6. Respect for Intellectual Property

  • The platform’s software, design, and branding belong to Khaos Adventures LLC.
  • You may not copy, alter, or redistribute the Service without permission.
  • Copyright complaints should be sent to dmca@khaosadv.com.

7. Service Availability and Termination

  • We may suspend, modify, or end the Service at any time without notice.
  • We may terminate accounts for violations or if legally required.
  • You may delete your account at any time; data is handled under our Privacy Policy.

8. Disclaimers

The Service is provided “as-is” and “as-available.” We disclaim all warranties, including merchantability, fitness for purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free service.

9. Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability is capped at USD $50, regardless of cause.

10. Indemnification

You agree to indemnify and hold harmless Khaos Adventures LLC and its affiliates from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service,
  • Your content,
  • Your violation of these Terms or applicable law.

11. Governing Law and Jurisdiction

These Terms are governed by and interpreted under:

  • U.S. law (Arizona) – for U.S. users.
  • EU and German law – for users in the EEA, UK, or Switzerland, where data is hosted.

U.S. users agree to the exclusive jurisdiction of Arizona courts. EU/UK/Swiss users may bring claims in German courts under consumer law. Nothing removes your mandatory rights under local law.

12. Final Clauses

  • We may update these Terms at any time; changes apply when posted.
  • If any part is invalid, the rest still applies.
  • These Terms are the entire agreement between you and Khaos Adventures LLC.
